New cloud law also allows US authorities to access data in Europe

The recently ratified "Cloud Act" gives US authorities extensive rights to access cloud data hosted abroad by US providers.

New cloud law also allows US authorities to access data in Europe

On March 23, the "Cloud Act" came into force in the USA, according to which US authorities may also access cloud data hosted abroad on servers of US companies.

According to this, Amazon, Micorsoft and Co. can only appeal to a US court if the person concerned is not a US citizen or the provider violates the respective national law in which the data is hosted by releasing the data. In order to make this procedure palatable to other states, there is the possibility that the U.S. president concludes direct agreements which then regulate this flow of data bidirectionally, bypassing the courts.

However, since the law does not provide for an obligation to inform the persons concerned, the possibilities to take action against this are quite manageable, especially since it will probably often go unnoticed.
